1. Acceptance of Terms

By accessing or using FrameIt (the "Application"), provided by Odd Omens LLC ("Company"), you agree to be bound by these Terms of Service ("TOS"). If you do not agree to these TOS, please do not use the Application.

2. Changes to Terms

The Company reserves the right to modify or revise these TOS at any time. You will be notified of any changes through an updated "Last Updated" date. It is your responsibility to review these TOS periodically. Your continued use of the Application following any changes constitutes acceptance of those changes.

3. Use of Application

3.1. License: The Company grants you a limited, non-exclusive, non-transferable, and revocable license to use FrameIt for personal or business purposes, subject to these TOS.

3.2. Prohibited Activities: You agree not to:

• Use FrameIt for any unlawful or fraudulent purposes
• Copy, distribute, or modify the Application without our express consent
• Attempt to access or use accounts, data, or information not belonging to you
• Engage in any activity that disrupts or interferes with the proper functioning of FrameIt
• Reverse engineer, decompile, or disassemble any part of the Application
• Use FrameIt to transmit any viruses, malware, or other harmful code

4. Privacy

Your use of FrameIt is also governed by our Privacy Policy. By using the Application, you consent to the collection and use of your information as described in the Privacy Policy.

5. User Content

FrameIt allows you to create and export mockups. All content you create using FrameIt remains your property. The Company does not claim any ownership rights to your content. All data is stored locally in your browser and is not transmitted to our servers.

6. Disclaimer of Warranties

FrameIt is provided "as is" and "as available." The Company makes no warranties, expressed or implied, regarding the quality, accuracy, or reliability of the Application. Your use of FrameIt is at your own risk. To the fullest extent permitted by law, the Company disclaims all warranties, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of Liability

In no event shall the Company be liable for any indirect, consequential, special, incidental, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of FrameIt, even if the Company has been advised of the possibility of such damages.

8. Indemnification

You agree to indemnify and hold the Company and its affiliates, officers, directors, employees, and agents harmless from any claims, losses, or damages, including reasonable attorney's fees, arising out of or related to your use of FrameIt, your violation of these TOS, or your violation of any rights of another.

9. Governing Law

These TOS shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. Any legal action or proceeding arising under these TOS will be brought exclusively in the federal or state courts located in Minnesota, and the parties hereby consent to the personal jurisdiction and venue therein.

10. Severability

If any provision of these TOS is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law.

11. Entire Agreement

These TOS, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding the use of FrameIt, and supersede all prior agreements and understandings, whether written or oral, regarding such subject matter.
